Being involved in a law suit can be an intimidating and
frustrating experience both for those who’ve never had such
an experience before and for those whose profession or institutional
setting make it a part of every day life.
The particular tactics and strategy employed in any given
case will inevitably depend upon the particulars of the
dispute that leads to court proceedings and the procedural
rights, remedies, and rules that apply to the conduct of
the dispute in any particular jurisdiction. However, regardless
of those particulars, conducting a lawsuit, that is litigating
it, intelligently can both strengthen your case in court
and reduce your costs, frustrations, and anxieties while
you go through the court process.
Litigating intelligently starts with making the right choice
of counsel to represent you in court, and continues with
maintaining an optimal working relationship with that counsel
throughout the proceedings. This will ensure you have as
much information about and control over your case as you
want and need, at a cost that’s viable for you to bear.
Choosing counsel and instructing counsel are easier if you
have an understanding of what you need to think about before
you start, and if you know a little bit about the judicial
processes you may be engaged in.
